Is the Hardship Not Sufficient?
The court said the amount of hardship that the person showed was not sufficient to meet this exceptional and extremely unusual hardship standard. The question is, if everybody agrees on the fact, can you then make a determination about whether those facts are going to be reviewed? And so that's what's going to be potentially pending into the Supreme Court.
