The 14th Amendment Protects Historical Occupied Groups

The 14th Amendment was passed in the wake of the Civil War. It means that it protects historically oppressed groups, but courts need something to give force to that. The court scrutinizes laws much more intense if a law discriminates against historically oppressed groups.
