Pence has raised executive privilege before in a different investigation into January 6. He said it would be inappropriate for the legislative branch to come in and basically haul off, haul into Congress the vice president. The principle in the speechred or baked clause legislative immunity context is really the same. So this is clearly just politics by Pence; he's trying to run against Trump without really running against him.
