Justices Thomas and Jackson took shots at each other in footnotes to their descents. The phrase affirmative action first appears in 1961, when JFK creates the Committee on Equal Employment Opportunity. In 1969, many elite universities admitted more than twice as many black students as they had the year before. Friends, I know we're going to come back to this later today, but what I want to underscore is that affirmative action and race was a consideration of ways that certain Americans had been oppressed throughout our history.
