The Importance of Dignity in Rights Theory
I view dignity as very unproductive as a way of justifying the extension of rights, and I think that there are other ways that might be more productive like Nussbaum's conception of flourishing. We need to inject complexity into our legal thinking in order to properly adjust these kinds of, you know, kinds of concerns so that we can adjudicate them. This really disrupts some of our conventional notions about what could be considered a proper legal subject or member of a moral circle.
