Alan Dershowitz has been practicing law since the late Cretaceous. The judge went above and beyond to try and construe this behavior in as maximally generous a manner as possible. He said, well, it's a close call, but I'm not going to sanction either of the parties or their attorneys for the argument that you could conduct a hand recount and base it on the way we did the cyber ninja recount.
