Data Breach Cases - Is There Standing?
The test for standing is that a person has to have suffered some sort of actual injury. The supreme court in 20 21 made standing in these types of data breach cases much more difficult to establish. It was a case called transunion l c vers mires, and they said that the threat of future harm does not provide standing for a damages claim in a data bea in a data breach case.
