Is the Supreme Court a Counter-Violetarian Institution?
In the 1960s, Alexander Bickel wrote a book called The Least Dangerous Branch in which he criticized the court as being counter-vigitarian. He suggested that judicial review allowed an unelected, life-appointed Supreme Court to strike down laws and policies enacted by voters. In seven of the last eight presidential elections, the Republican candidate has lost the popular vote.
