A New Theorization of the Fatoi

The book is about the fatoi as a gendre, in terms of its form and purpose. The author also argues that moslem jurists were stripped of their interpretive freedom after the tenth century. Ancherese epitomized this orthodox opinion within the malache school because he was unable to adapt law to new realities. And these two characterizations actually capture farewell too to in islamic legal history.
