The Problem With the Luxembourg Court of Justice
Max Rems: The court of justice doesn't have authority to set rules for anybody except people who come before it with litigation that NOIB has chosen to bring up against their adequacy determination. If you look at the OECD, which brought together 39 democracies to talk about what the limits on surveillance ought to be, they came up with limits that are very different from what the court has proposed. Most countries have been through this and arrived at more or less the same place.
