How to Write Good Rules for Human Subject Research

Once you've committed yourself publicly to a particular point of view, most people have a lot of trouble changing their mind. The puzzle I've had over the 45 years or so that I've been a lawyer is how do these patently bad ideas get put into practice and stay there so tenaciously? So I think that part of the reason is that people underestimate how hard it is to write good rules. They say there ought to be a law and with the IRB's they say research subjects shouldn't be abused. But what this means is you're suggesting ... once people adopt a position it's extremely difficult to shake their minds with any new evidence.
