The Marshall Court's Objection to the Jeffersonians

Jeffrey Toobin: Federalist judges ran against Jefferson's understanding of the Constitution. He says in Martin versus Hunter's Lassie, a federal judge said he couldn't tell Virginia court to do something it didn't like. In other cases, Thomas Jefferson suggested death penalty for people who helped enforce first bank charter; these were all hot matters as far as Jefferson was concerned.Toobin: The American Revolution had delegated some power to the federal government but not power to come up with any kind of command it wanted to come out with.
