The VA gives the surviving spouses of service members who died in the line of duty or from a service-related injury or illness, tax-free monetary compensation. But there has been a marriage requirement of eight years in order to receive enhanced benefits. This excluded same-sex couples because the Supreme Court's decision in Obergefell v. Hodges, which guaranteed the right to same-sex marriage, was decided in 2015,. only seven years ago.
