You need to get to like a third of mining pool power to pull off some of these attacks. But there are groups that actually control a third. That's th amount you would need is like 30 % for some of like the uncle bandit at takstofya 33. Why don't they do it? I think it is a recognition that it would probably hurt the chain. There was probably many legal issues that would open up.
