An amicus brief filed by the Trier Justice Center argues that bivens actions are super important in lots of different situations, but including when there are sexual assaults. So again, these strange bad fellow moments may be quite tactical. And I think in this case, it was a quite tactical decision to join with conservatives to avoid that larger question.
