The Australian Government's Response to the Australian Torture Case
The international criminal court's jurisdiction only steps in should a state fail in its own obligations. The ICC is meant to be a court of secondary venue. I can't imagine Australia doing that. An Australian senator had made a referral to the ICC, which is also another interesting anomaly. What I'd like to stress is that national authorities need to take up action. We can't rely on these international courts to be doing the work that ordinary governments and ordinary prosecution services should be doing.
