A Different Approach to Constitutional Law
I understand the temptation of collective rights, but there is something majestic about our legal system that in every case somebody has a personalized stake in the outcome. We don't burden our judicial system with things that are merely theoretical or based on some type of hunch that something bad is going to happen. And I think because we have a common law system, meaning judges look to past decisions to guide them in future decisions, we can actually learn a lot about the law from multiple cases.
