Public discourse rather than being a market for ideas is mostly a market for justifications. Hugo Mercier's work says people have beliefs that they want to believe, and this is the confirmation bias we suffer from so much. So as a lawyer in a metaphorical sense, you're looking to ignore or push away ways of saying things that would actually prime people to go in a different direction from what you want them to go. And clearly it's really in our interest to take that first path.
