Is There Chevron Deference?
What Chevron deference means is if there is an ambiguity in a statute, then the court will grant deference to an agency interpretation of ambiguity. Here they say, no, not for criminal penalties, not for a regulation that carries with it a criminal penalty. The Fifth Circuit basically lifted one arm and extended the middle finger to multiple other circuits when it issued a statement. It's all about gas stations. How dare you mislead our listeners?
