David Gergen: The outcome here wasn't surprising at all. And the unanimity of it wasn't surprising to me either. There was a two-factor test followed by a six-factor test, but it all came down to was your assistance knowing and substantial, knowing and substantial. Once that's the test that's applied, there was no way Twitter was going to lose its case. But because the Twitter case said they couldn't be liable under the anti-terrorism act for aiding and abetting, it doesn't actually matter whether section 230 would even protect them from liability. So we're sending it back down. At this case is done. Pretty unsatisfying.
