Equal Protection - What Is the Levels of Scrutiny?
The equal protection clause prohibits the government from denying citizens equal protect under the law. On an exam, look out for laws that classify people into groups. Suspect classes include things like race, nationality, citizenship status and religion. If either of those categories apply suspect class or fundamental right, the court will apply strict scrutiny. In such a case, the government show the law is narrowly tailored to address a compelling state interest. And finally, we have rational basis review, which applies when a law regulates any other class or group of people.
