If there were no legislation on the books, what would the constitution say about congress's role in choosing the president? There is some dispute among election scholars about exactly the relationship of the constitution to the electoral count act. In a world where electors were appointed by state legislatures directly, at least in many states, there wasn't any popular to recount.
