Why Was Burr Ultimately Not Convicted?
The Constitution lays out two possibilities for treason. One is to levy war against the United States and one is to give aid in comfort to the nation's enemies. Burr simply wasn't there. It was a highly problematic case because it's not at all clear that Ohio militia are the United States Right if you have to levy war, can you really say that raising your guns against them even counts?
