The cert grant focuses on a single issue: Whether a public accommodation law violates the free speech clause. The state of Colorado argued that Smith, who had not yet entered the market and had not yet accumulated customers, lacked an injury sufficient to confer standing. And it does seem to me as though this kind of complete willingness to just bulldoze right past these threshold jurisdictional questions is emerging as a major theme of this term already.
