Can the Owner Recover the Five Thousand Dollars Extra He Paid the Painter?
The original painter agreed to paint the bakery by february first for ten thousand dollars and failed to do so. The owner could not find another painter to do the job by febFebruary first, but he was able to find some one to do it by march first for 15 thousand dollars. Therefore, the owner is five thousand dollars worse than if the original painter had performed under the contract. These are consequential damages because they don't result directly from the breach, but rather from the owner's special circumstances.
