Justice Kagan Is a Realist. She's Calling It Like It Is
Justice Kagan is being a realist. She's saying what she sees in front of her nose, and Chief Justice Roberts and Alito are making the argument that it's not legitimate for a Supreme Court justice to question the court's legitimacy. And so their stance, particularly Roberts, is to say if the public disagrees with the court, that's how it goes. Essentially, that there is no check from public opinion on us.
