Is the Supreme Court Overturning a Row a Threat to Trans Related Claims?
If row is overturned by the supreme court, does that make the fight to protect trans people's autonomy even tougher? I am not really familiar with successful privacy based arguments or fundamental rights arguments with respect to health care for trans people. Doctrinally, overturning of row and sort of the substantive to process doctrine being eviscerated, as it likely will be, doesn't have the most direct impact on trans related claims because they are largely not pursued under our rights of privacy theory. But i don't think we can say that anything is safe under this court.
