The Unsettled Future of College Admissions
The Supreme Court's ruling on affirmative action leaves open the idea that people can talk about race as part of their life experience when they write their essays. But Justice Thomas and Justice Kavanaugh in their concurrences did talk about considering disadvantage in a way that made me think at least that they remained open to the idea. And I just think all of that is amazingly unsettled now, which will lead to a lot of future litigation.
