Anonymity in a Clinical Negligence Claim

A high court decision was handed down concerning an anonymity application in a clinical negligence claim. On the first day of the trial, the claimant applied for an anonimity order to prohibit publication of her name. The press association intervened and argued that although the claimants article eight e c h rights were engaged, the court also had to consider article ten,. namely, the freedom of the press.
