Chad GPT and the EU Plan to Regulate AI

Europe has been working on the AI Act, which is really a very ambitious effort to introduce regulations. It doesn't look like there's much consideration for things like Chad GPT and the AI Act. There's some argument as to whether in this kind of they brought technology of a chatbot, should this be classified as a high risk thing where you are required to be transparent and have human oversight?
