Is There a Crime Fraud Exception to Executive Licensing?
It's the lawyer's initial duty to assert privilege when there's one available, but then to take ction from the client about whether or not to answer. And here it's the institution that holds the privilege, not the particular individual in it. Is there a crime fraud exception to executive lege? Well, since the doctrinis entirely manufactured, as pointed out before, there's no reason there shouldn't be. But i don't think a court has expressly recognized it as such.
