The Different Uses of Copyright in the Visual Arts
Jeffrey Coons' use of the Blanche photograph was certainly much more less of a copy and definitely created some new meaning. But also, again, to the narrowness of this decision, that was a difference also between a photograph that appeared in a magazine and an advertisement for Andrea Blanche. And so I think even looking at this decision, they might also say, well, that's a different use, a different purpose and a different use.
