One way is by having these competent authorities who might be local police be the ones to decide what has to come down. The platforms, if they think that it's an illegitimate use of power that there's a free expression reason not to take it down, they can challenge that but only later. So it's moving from from courts to local authorities in that way. Or alternately, if the authorities send a referral and they're asking the platform to use their terms of service to take something down, then a legal question never gets asked at all.
