The Equal Protection Clause and the Violence Against Women Act
The Equal Protection Clause prevents states from treating citizens unequally, but that's it. It does not allow the federal government to pass laws to further the cause of equality. Kermit Roosevelt, a professor at Penn Law who clerked for suitor who wrote dissent in US v. Morrison when this case came down, published an article titled "Bait and switch," why United States v. Morrison is wrong about section five. If we want a constitutional basis for a better world, a better country, there it is, staring us right in the face.
