Does the Not Withstanding Clause Exist?
The not withstanding clause exists because some provinces didn't like the idea of having a chart of human rights and freedoms. The way for the Constitution to be accepted and ratified by everyone, the way I'm going to look at it back was to have that clause in there so that it's like, yeah, human rights are important, but they can seem would be optional. There's an effect of a butterfly effect. If one person does it, everybody is like, why not us?
