After years of worry over what to say to Marilyn, Sven's finally found the right words. A judge made an official recommendation that based on Glenn and Judith Cherry's testimony, Paul's story's sentence be changed to life in prison without parole. After this episode first aired in 2018, the Texas Court of Criminal Appeals rejected the recommendation from the trial court judge,. The Supreme Court declined to hear the case, but Justice Sonia Sotomayor wrote a statement saying prosecutors misled the jury.

In 2008, Sven Berger was chosen to serve on the jury for a murder trial. He says the sentence that he and his fellow jurors handed down “felt like a mistake right away.”
