The State Secrets Privilege in the Foreign Intelligence Surveilar Act
The lawsuit was brought by three moslem americans who allege that the fbi paid a confidential informant to conduct a covert surveillance programme in southern california known as operation flex. The government asserted the state secrets privilege over certain categories of information and sought to dismiss some of the plaintiff's claims on that basis. It was actually a fairly unusual invocation of the privilege, because the challenged government programm was a purely domestic one.
