The court of appeal suggested that a former president may not successfully invoke the presidential communication ri for communications that occurred during his presidency. Justice cavanagh: A former president must be able to success fully invoke the presidential communications privilege, even if the current president does not support the privilege claim. Concluding otherwise would evicerate the executive privilege for presidential communications.
