The Importance of Jury Instructions in Criminal Trials
The flip side of the prosecution's burden to prove a case beyond a reasonable doubt is the presumption of innocence. There are two types of presumptions for jury instructions, rebutable and irrebutable. Any presumption that cannot be disproven or overcome is unconstitutional.
