The SEC's Purview of Cryptocurrency

In Terra Luna case the complaint related to receipt for a security. That's one of the first times that the SEC used the term receipt for to apply to cryptocurrency. I think crypto is different for a variety of reasons but one of those reasons is that it is not an instrument as defined it is just code. So there's no bundle of rights that are accompanied by the crypto asset itself so when you think about the enumerated list of financial instruments that are securities you see that each one of those is an instrument.
