Justice Kavanaugh's Delegation of Executive Power to the Education Department
Justice Kavanaugh said some of the biggest mistakes in the court's history were deferring to assertions of executive or emergency power. He did say that he was referring to the seizure of the steel mills in the Korean War by President Truman. The other justices didn't seem to pick up on this I mean they all would agree that the education secretary had the power to say okay let's wait three years before we collect your loans and not charge any interestLet's wait five years that would have been okay but the question of cancellation maybe that was too far in the minds of at least a number of the justices.
