Judge Torres affirms the view that the same crypto asset may be sold as an investment contract and therefore a security end as a standalone good. The SEC will have to prove in every case that that reasonable purchase is based on an expectation of profits from the issuer or from some identifiable other. It's very difficult to prove that people are kind of undertaking to invest in some enterprise when they're just buying XRP.
