Introduction

This chapter explores the question of whether the denial of voting rights to former felons is considered cruel and unusual punishment and how it relates to the denial of Second Amendment rights. The implications of a recent case from the Fifth Circuit, where a ban on voting rights for certain felons was deemed cruel and unusual punishment, are discussed, along with the distinction between positive rights and preexisting rights.
