The Supreme Court's Decision on Fraud
When fraud was initially put in the federal code, it happened in about 1870. There were six or seven theories floating around that tried to extend the idea of fraud beyond a financial crime. A lot of them were of the nature of a scheme to defraud people out of honest services. In 1987, the Supreme Court decides a case called McNally in which they say emphatically fraud is not allowed.
