Gonzalez changed the question presented going from the petition to the merits. That's just a bad idea because if the justices decide that the posture of the case is not what they thought it was, they can dismiss the case as in providently granted. Google mentions this in their brief. They're not heavy handed about it, but they remind the court that that is a possibility. So I don't know. If you put money on that, it's like you're betting on 26 red and seeing if you, you know, you hit the jackpot, not likely.
