Reform of the Electoral Count Act

The Electoral Count Act of 1887 sets out the rules for counting the electoral votes and certifying who is the winner. The 2020 election revealed a number of weaknesses in the ECA, which should be reformed to prevent rogue states or governors from trying to change the rules after Election Day. And finally, the reform should make clear that the vice president who presides over the certification in Congress does not have the power to simply negate or throw out electoral votes.
