Samuel Alito wrote an opinion that would have invalidated the Trump EPA department's regulation as too environmentally friendly. Justice Kavanaugh and 3 Democratic appointees adopted a broader understanding of what wetlands EPA could regulate. The bottom line is that Scott Pruitt, who literally spent his career as a lobbyist for big oil, is apparently too environmentally friendly as an EPA chief.
