The Basic Concept of a Rent Cap

The existing bill that's been around for since 2019, which I support, would say that a rent increases presumptively unreasonable if it exceeds a certain threshold. In California, the threshold is the consumer price index plus 5 percentage points or 10% total, whichever is less. And what that, what California has said is that if you exceed that amount, if you propose a rent increase that exceeds that amount, it is a rebuttable presumption that it's unreasonable. The landlord can go to court and say, I'm a victim because they're not willing to pay a rent increase. If it succeeds that, that threshold, then it would be presumed to be unreasonable.
