The DEA and DOJ Propose New Changes to the 2008 Telemedicine Act
The general requirement is that the prescribing practitioner must have conducted at least one in-person medical evaluation of the patient. The data from COVID should be used as part of a cost-benefit analysis to determine whether it is reasonable to regulate telemedicine, and if so, what regulations might address whatever problems arose. It seems like a colossal overreach to ask an executive branch agency to overrule the plain text of the act.
