It could in fact be used as a way of getting around the Americans with Disabilities Act. Many neurodivergent people like Autistic and Bipolar people and people with ADD have problems with being labeled too intense. If employers screen out candidates who test as overly intense, they'll screen out many people with disabilities, which is illegal.
